CASL - Canadian Anti-Spam Legislation

The Canadian Anti-Spam Legislation – also referred to as CASL – was introduced by the Government to regulate the use of electronic messages, both commercial (CEM) and private.

This legislation is not just to control unwanted emails or junk/spam mail as we often refer to it. The legislation is much more far reaching and was introduced to protect users by requiring them to “opt-in” or provide implicit consent to an organization in order to receive messages from them.

All requests for consent from an organization – including the consent form - must meet certain criteria and must allow the withdrawal of consent at any given time. The same legislation applies to mobile devices such as tablets and phones where applications cannot be installed without the user being able to provide consent. This legislation applies to almost all computer applications. This is so users are protected from the installation of applications – many malicious - on their devices without their knowledge.

CASL applies to all electronic messages and applications where the computer system used to send/receive messages or access application is based in Canada. Any organization outside of Canada which sends a message or installs an application on a device in Canada must adhere to all CASL requirements.
